We try and keep our service as simple and straightforward as possible, and it’s rare we have any disagreements with clients but to help prevent and resolve problems please refer to our Terms and Conditions of business.
IMPORTANT NOTICE: These terms and conditions for services supplied by websitesforescorts.co.uk (including services provided by third parties appointed by us) set out the agreement between you and us under which we will provide you with web design, hosting, email and any other service we agree upon. It is in your interest to read them carefully. If there is anything that you do not understand then, please contact us.
Contract
This contract is made between websitesforescorts.co.uk (“us/we”) and the company, firm, partnership or individual ordering web design, hosting, email and/or another service (“you/your”).
No variation of the terms of this contract however notified will be valid unless accepted by us in writing (including email).
If any of the information you give us changes (e.g. name, address, telephone number, payment details), you must inform us promptly.
By entering into a contract to build a website you accept that you are 18+, work for yourself (not managed by another person/s) and you are legally entitled to work in the UK (IE you have a UK National Insurance number) We are obliged to share info where we believe a person/s is under 18 years, working against their will or working illegally in the UK. Other than these legal obligations we will NOT share any information you provide to us.
Web Design
You acknowledge that in providing a web design service, we are not giving consultancy or any other advice regarding the information that you may choose to place on your website.
You will be asked to pay a deposit before work on your site begins. Deposits are strictly non-refundable.
If you cancel an order for web design, you will be required to pay us for any work undertaken up until the point of cancellation if the value of work undertaken exceeds the deposit paid
Email, web hosting and your website
You acknowledge that you are responsible for all content included on your site. You are responsible for the material that you or anyone else puts on your website(s). All websites must be for legitimate purposes, and content including links from your website(s) to other websites must be lawful.
You are responsible for ensuring that all necessary licences and consents (including those from owners of copyright, performing rights and other intellectual property rights) have been obtained, and you agree to indemnify us against any action commenced against us by any party as a result of infringement of any licences, consents or other rights.
Allocated web space is for use by you only and cannot be used by a third party.
We generally will make any reasonable changes to your website in the first two months after your site is launched. This will enable you to ensure your content, photos, links etc. are just how you want them. After this, we will make a charge for making changes to your site. We charge a very nominal fee (currently £20-£25) per alteration to minor text and/or links and/or photos, however, if you require significant revisions IE additional pages, re-write of pages etc. we will quote and charge accordingly for the time taken.
Data transfer (bandwidth) is limited each month (though you are unlikely to even get near its limit with normal usage!). Once the limit has been reached in any month your account may be temporarily suspended until the first day of the following month unless you have agreed to pay for the data transfer more than the monthly limit. This is rare as we always try to ensure you are provided with sufficient bandwidth. Reasons for overrunning your allowance could be the inclusion of video files, linking too/from ‘top list’ kind of sites. We may impose limits (which we may vary from time to time) on the storage space, web-space, number of mailboxes, email messages that can be stored and/or the size of any attachments you can send/store to ensure the quality of the service to you and other users. We may reject or delete material that exceeds these limits.
You must ensure that all usernames and passwords provided by us are kept confidential, secure and are used in accordance with relevant instructions. If you suspect that any password is being, or is likely to be, used in an unauthorised manner or if you think that any username or password has become known by someone not authorised to use it, you must notify us immediately.
Due to repairs, planned maintenance, upgrades or any other operational reason we may need to suspend the service temporarily. In this event, we will endeavour to provide you with as much notice as possible.
By entering into a contract to build a website, you agree that you are of legal age to undertake the services you offer and you are legally allowed to work in the UK.
User Updatable websites
If you opt for a user updatable website, you will be supplied with a username/password plus written and verbal instructions on how to maintain your site. The user panel will allow you access and be able to maintain the following: photographs, page text, availability, adding banners/links etc. The maintenance section will also let you to make further more complex changes to the site (e.g. adding pages, making changes to fonts, colours and layout etc.) these additional functions are more complex, and we do not allow access as errors made here can affect the site stability. We will make any such changes you require for a nominal fee so please contact us to discuss. Should advanced featured be accessed and we need to ‘fix’ errors made we will charge for our time in doing this.
Content
We may require assurances that you are legally entitled to ‘use’ images you supply to use on the website. Please be advised it is illegal to download and reuse 99.9% of all photos available on the internet. We are not responsible for any material you upload to yourself but should we receive any complaints we may ask you to remove content as it is hosted upon our server and we have to ensure compliance of the laws relating to this.
Domain names
We will register domain names with the internet registration authorities and will pay registration and rental fees on your behalf.
Domain names are registered on a first come first served basis. Until you receive confirmation from us, there is no guarantee that your request has been successful. We accept no liability for unsuccessful domain name requests.
Charges for domain registrations are not refundable once a domain name has been registered.
For all domain name registrations you are entering into a contract with one or more registration authorities, and their terms and conditions apply.
A domain name is registered for a minimum period of 1 year, after which time it will need to be repurchased. We will endeavour to contact you in advance of the renewal date, but ultimately you are responsible for renewing your domain name before it expires.
You acknowledge that the registration authorities will resolve any dispute arising out of the use of any domain name.
Domain names will be registered to us unless otherwise specified at the time of purchase.
Payment & charges
Deposits will be required before work commences and the balance will be due on completion of the website build.
You have to pay our charges by the due date stated on our invoice. Non-payment (or persistent late payment) of our legitimate charges may result in suspension or termination of your account without prior notice. You will still be liable for costs during any period of suspension.
Title to the goods (including but not limited to web design, hosting, email, domain names and/or another service) remains with the vendor until the invoice is paid in full. If the due date does not make payment, we may suspend or cancel the service and may forward the debt to an external agency for collection. You will pay our reasonable costs and expenses for collecting late payments.
To keep costs and paperwork to a minimum, invoices are sent via email.
Should you wish to alter, amend or cancel your contract, please do so before the due date shown on the invoice. Otherwise, invoice charges are payable in full.
Search Engine Optimization (SEO)
We provide (included in your initial fee) basic SEO to enable search engines to find and display your website. Please ensure you are aware of the level of SEO we offer and you are happy with this. We recommend additional SEO services for commercial sites such as Parlours/Agencies etc. which we will happily quote you for. Our websites are not compatible with 3rd party SEO packages, but we offer incredibly competitive terms for this service. Individual escort site SEO setup is generally more than sufficient for Google etc., providing you also use an Escort Directory advertising too for your new website. Please read the marketing section of the website for more information.
Termination
You may terminate this contract by giving us notice at any time. Termination will be effective from the last day of the period for which you have already paid or the last day of any other agreed minimum period if later and you are liable to pay all charges up to the effective date of termination. If you wish us to terminate the contract part way through a period for which you have already paid, no refund will be given for the remainder of the pre-paid period. Where we charge you a monthly fee to maintain/manage your site if a bill remains unpaid 14days after the due date, the site will be suspended without notice, and an additional charge & delay will be incurred before the website is back up and running. Please help us out here as we do not like having to chase up payments.
Either of us can end this contract immediately on notice if the other: (a) commits a material breach of this contract, which is capable of remedy, and fails to remedy the violation within a reasonable time of a written notice to do so; (b) commits a material breach of this contract which cannot be remedied; (c) is repeatedly in violation of this contract; or (d) is the subject of bankruptcy or insolvency proceedings or an arrangement with creditors is made, or a receiver or administrator is appointed over any of their assets, or they go into liquidation.
We can end this contract with immediate effect if we have previously terminated your use of any service due to your breach of any terms of this contract, including non-payment or persistent late payment of invoice charges.
Our liability to you
We have no liability (whether in negligence or otherwise) for any indirect or consequential loss, nor for any loss of opportunity, goodwill, reputation, business, revenue, profit, or savings you expected to make, wasted expenditure or data (including but not limited to emails) being lost or corrupted.
Changes to this contract
We may change this contract, including our charges, at any time. Changes will be published on this web page, and your continued use of the service constitutes acceptance of changes. You can end this contract by giving us seven days notice if we increase our charges or change the conditions of this contract to your detriment.
Giving Notice
Any notice under this contract must be given in writing which may include by email
You are responsible for checking the mail sent to the email address provided by you as part of the service.
Waiver of rights
Neither of us shall be considered to have waived any right under this contract because of failure or delay in exercising that right.
Third party rights
A person who is not a party to this contract has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract, but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
The law relating to this contract
English Law governs this contract, and we both agree to the exclusive jurisdiction of the English law.
